Microsoft Stokes Linux Fears

Software giant's patent claims against Linux could help steel it against open-source rivals.

Call it a pre-emptive strike. Microsoft has said that Linux and open-source software violate 235 of its patents, a claim that observers believe is a tactic to sow fear, uncertainty and doubt among companies that are considering using open-source software. Microsoft's surprising claim, made by general counsel Brad Smith in an interview with Fortune, came mere weeks before the Free Software Foundation is due to release a new open source license that will govern Linux use. The license, known as GPLv3, could isolate from the wider open-source community any open-source software developed by Novell and Microsoft (see Microsoft's Linux Woes) under a cooperation agreement between the two companies (see Microsoft, Novell In Linux Pact). Observer suggested Microsoft's surprising patent claim was designed to raise intellectual property concerns among corporate customers thinking about using Linux software distributed by companies other than Novell.
